Definitions:

1.3. Use of the website www.botanikasoul.com and the purchase of products available therein imply the reading, understanding and acceptance of these Terms and Conditions by the user.

2.1. To make a purchase, the user can register in advance by filling out the form available on the website. www.botanikasoul.com .

2.1.1. After registration, the user will have access to his/her personal account , where he/she will be able to manage his/her settings, view his/her wishlist and track his/her orders.

2.2. It is also possible to place orders without prior registration .

3.3. Botanika Soul reserves the right, at any time, to change or update information, product offers, prices, promotions and commercial conditions presented on the website.


4. Buying on the Website

4.1. To purchase from www.botanikasoul.com , it is essential that the user has an email account and that their internet browser is configured to accept cookies and pop-ups , ensuring the best browsing experience in the online store.

4.2. The user can purchase products online by following these steps:

  • Find the desired product(s);
  • Add the selected product(s) to the "Shopping Cart" ;
  • Register your personal data as a user, which will be stored in the Botanika Soul database , as provided for in our Privacy Policy ;
  • Review and confirm the order.

4.3. After confirming the order, the user will receive a confirmation email , containing details about the chosen payment method.

4.3.1. Once payment is completed, the user will receive a new payment confirmation email .

4.3.2. The invoice will be sent by email to the user's email address after payment confirmation, and it is the user's responsibility to download, save and/or print it .

4.4. All data from completed orders will be available for consultation in the customer area at www.botanikasoul.com .

4.5. All orders sent to Mainland Portugal and Islands, Europe and other countries will be delivered by the carrier contracted by Botanika Soul , to the address indicated by the user during the ordering process.

4.6. By submitting the order form, the user declares to have read, understood and accepted these Terms and Conditions of Purchase described on www.botanikasoul.com , as well as our Privacy Policy .

4.7. Botanika Soul reserves the right not to accept and cancel orders already confirmed in the following cases:

  • The product is not available in stock;
  • Payment is not made using one of the options available on the website www.botanikasoul.com ;
  • Payment is not confirmed;
  • The billing information provided by the user is incorrect or impossible to verify;
  • There was an error in the price quote;
  • Delivery is not possible to the address indicated by the user.


5. Prices

5.1. The prices advertised on www.botanikasoul.com already include VAT (Value Added Tax) at the legal rate of 23% .

5.2. Prices are shown in EURO (€) currency.  and include applicable taxes, but do not include any customs fees for international purchases. Product prices are fixed, and there may be promotions or discounts.

5.3. Prices advertised on www.botanikasoul.com may be changed without prior notice. However, if an order has already been completed by the user, the prices in force on the date of the order will remain in effect.

5.4. If an error is identified in the price of a product ordered, both Botanika Soul and the user may, up until the order is dispatched, choose to cancel it.

5.5. The total checkout price of the order includes taxes from the country of origin (Portugal) and shipping costs , where applicable.


6. Payment Methods

6.1. Purchases made on www.botanikasoul.com can be paid for using the following methods:

  • Credit and debit cards: Visa, Mastercard, American Express, Maestro
  • Digital payments: Apple Pay, Google Pay, Shop Pay, Union Pay, PayPal, Klarna, Cofidis Pay
  • Local methods: PayShop, MB Way, Multibanco Reference

6.2. Botanika Soul does not accept any other payment method other than those mentioned above. Therefore, it will not be held responsible for payments made by other means , nor will it be obliged to reimburse the user for any losses arising from payments made outside of the official options.


7. Billing

7.1. After confirmation of payment of the order, Botanika Soul will issue the corresponding electronic invoice, which will be sent to the user by email to the email address provided at the time of purchase.

7.2. The user is responsible for downloading, saving and/or printing the electronic invoice , as it will serve as proof of purchase.

7.3. If the user requires any correction to the billing data, he/she must contact Botanika Soul as soon as possible via email at info@botanikasoul.com , before sending the order.

7.4. Botanika Soul may not change billing data after the invoice has been issued, as provided for in applicable tax legislation.

7.5. The invoice will be issued in accordance with the data provided by the user at the time of purchase. It is the user's responsibility to ensure that the data provided is correct and complete.


8. Shipping costs

8.1. Shipping costs to mainland Portugal and the islands, Europe and other countries vary according to the weight of the order and are the responsibility of the user. The corresponding amount will be displayed in the shopping cart, allowing the user to check the costs before finalizing the purchase.

8.2. The shipping cost is shown including VAT at the legal rate of 23%.

8.3. There are no additional costs to the shipping costs determined at the time of the order by the user.

8.4 In atypical cases, A Botanika Soul will always have the legitimacy and possibility to exempt the user from shipping costs.



9. Deliveries and shipping

9.1 Orders are sent via CTT Correios de Portugal, by Registered Mail and/or Blue Mail with tracking code. Estimated delivery times:

  • Portugal and Islands: 3 to 4 working days
  • Europe: 5 to 10 business days
  • Rest of the World: 10 to 20 business days (may be less or more, taking into account peak season periods or other factors)*

* Botanika Soul is not responsible for delays resulting from external factors, such as strikes, customs clearance or periods of high order flow.

9.2. Botanika Soul undertakes to send orders completed by the user from Monday to Friday , between 09:00 and 18:00 , except on holidays and public holidays .

9.3 Completed orders, once prepared and properly packaged, will be sent to the user within 24h - 72h.


10. Campaigns, Promotions and Discounts

10.1. Botanika Soul reserves the right to define campaigns, promotions or discounts ( Campaigns ) according to the strategy for different destination countries.

10.2. Campaigns are subject to the specific conditions of each promotion and to these Terms and Conditions . In the event of conflict, the specific rules of the Campaign in force will prevail.

10.3. If a Campaign involves the offer of a product, exercising the right to return the purchased product will also imply the return of the offer product.

10.4. Offers received cannot be sold or transferred to third parties for profit.

10.5. The user may waive the free offer, but may not claim any compensation for such waiver.

10.6. The application of the Campaigns will only be valid after payment of the order within a maximum period of 24 hours .

10.7. During Campaigns, deliveries may be delayed.

10.8. All Campaigns are subject to stock limits and may be changed at any time by Botanika Soul . In the event of an error in price, stock or other information, the company reserves the right to cancel orders.

10.9. Unpaid orders may be cancelled after 24 hours or in the event of stock shortage.


11. Exchanges, Returns and Refunds

Customers who purchase Botanika Soul items through the website have the right to free resolution under the terms of article 11 of DL 24/2014, of February 14 .

Botanika Soul is committed to offering an excellent service, ensuring customer satisfaction. To this end, we offer a return and exchange process for your convenience:

  • Return : can be made within 14 days after receiving the order.
  • Exchange for another item : can be made within 30 days after the date of purchase, as long as it is for an item of equal or greater value.
  • Cancellation : the 14-day period applies from the date of receipt of the order.

To start the process, the client must contact us by email at info@botanikasoul.com . Each case will be analyzed individually.


11.1. Return Conditions

For the return to be accepted, the following requirements must be met:

  • The item must be returned in its original packaging and without signs of use.
  • The cost of return shipping is the customer's responsibility and will not be refunded.
  • The refund will be processed using the same payment method used for the purchase , after the product has been received and evaluated.

11.2. Assessment and Refund Process

Once the returned order arrives at Botanika Soul facilities , it will undergo a quality control to confirm that it complies with the return, exchange or cancellation criteria. After approval, the following rules apply:

  • Exchange of items : If the exchange is for an item of higher value , the customer must pay the difference . If the exchange is for an item of lower value , the difference will be refunded using the same payment method used for the purchase, unless expressly agreed otherwise, ensuring that the consumer does not incur additional costs.
  • Return of items : The purchase amount will be refunded using the same payment method used in the initial transaction, unless expressly agreed otherwise. The refund will only be made after the returned items have been received and inspected .
  • Cancellation : In case of cancellation, the purchase amount will be refunded using the same payment method used for the purchase, unless expressly agreed otherwise. Returned products must be in perfect condition , with no signs of use or damage, ensuring their resale.

Botanika Soul undertakes to process refunds within a maximum period of 5 days after receiving and checking the returned items.

11.3. Special Conditions for Returns

If the returned items show signs of use, such as dirt, dents, scratches, breaks or any other condition that makes them unsaleable, Botanika Soul reserves the right to not accept the return and refuse the refund.

11.4. Special Considerations

  • For personalized items , Botanika Soul does not accept exchanges or returns , due to its specificity.
  • The customer is responsible for the safe and proper shipping of items for exchange, return or cancellation. Botanika Soul is not responsible for damage or loss during transportation.
  • The user is responsible for shipping costs for exchanging or returning items.
  • If the customer receives an incorrect or defective item , they must contact our team directly through the “Contact us” menu or via email: info@botanikasoul.com in the online store so that we can prioritize the return, refund or exchange process.



12. Product Warranty

All Botanika Soul items come with a 2-year warranty , in accordance with Portuguese law. The warranty does not cover :

  • Discoloration, deterioration or oxidation due to contact with chemicals, creams, perfumes or water;
  • Loss and theft;
  • Natural wear of the gold or rhodium plating;
  • Modifications or repairs made by third parties, not authorized by Botanika Soul;
  • Improper or negligent use of parts causing breakage, dents, dirt, scratches or other types of wear caused by the user, including deformations caused by daily and/or inappropriate use.

For out-of-warranty repairs, additional charges may apply.


13. Complaints

All complaints submitted to info@botanikasoul.com will be responded to via this same channel, within a maximum period of 5 working days.


14. Intellectual Property

All Botanika Soul jewelry is an exclusive creation of the author. The images, logo and content of the website are protected by intellectual property rights. Reproduction without prior authorization is prohibited.


15. Policy for International Customers

International shipments follow the same procedure as national shipments. Botanika Soul is not responsible for any customs fees, delivery delays or other conditions imposed by the destination countries.


16. Applicable Law and Dispute Resolution

Alternative Dispute Resolution for Consumer Disputes

These Terms and Conditions are governed by Portuguese law. In case of dispute, customers may resort to the European Online Dispute Resolution Platform:

Under Decree-Law No. 24/2014 of 14 February , applicable to contracts concluded at a distance, the consumer has the right to freely terminate a contract, without needing to give a reason, within 14 calendar days , counting from the date of conclusion of the contract or receipt of the product purchased.

The decision to terminate must be communicated to Botanika Soul via email info@botanikasoul.com , providing the following information:

  • Full name;

  • Household;

  • Name of the purchased part;

  • Date of purchase.

In the event of cancellation within the indicated period, all payments made will be refunded using the same method used for the purchase, within a maximum period of 14 days after receipt of the notice of cancellation.

Botanika Soul reserves the right to change these Terms and Conditions without prior notice. The updated version will always be available on the website.
